Colleen Murphy’s impressive book presents a unified theory of transitional justice as a single, novel, distinct kind of justice, intended to guide normative evaluation of the choices transitional societies make in dealing with the past. I raise three central challenges to Murphy’s theory. First, how do we know that transitional justice is fundamentally a single special kind of justice that permits a grand unified theory? Second, is it plausible to hold, as Murphy claims, that societal transformation is (...) the overarching aim or objective of transitional justice? Third, is transitional justice convincingly explained as pursuing societal transformation ‘through’ or ‘by’ dealing with past wrongdoing? I argue that Murphy’s ambitious and finely detailed account does not fully reckon with dissensus about transitional justice in the field and does not adequately defend the central claim that transitional justice aims at societal transformation to be pursued by responding to past wrongs. The author affirms that it is stimulating not only social fragmentation and generalalienation but it is inciting total irresponsibility which contradicts with the dogmas of Christianity, ofchristocentrism in the market-place and the philosophical notions of Emmanuel Levinas who followsthese lead. The postindustrial forces manipulate by the individuals and reduce to the economicallogical imperatives rendering them into the screws of reproductional apparatus just like the producibleobjects. So there are eliminated all the possibilities of social solidarity and establishes “unconscionableconsumerism”. ABSTRACTTransitional justice encompasses a global body of scholarship and practice that concentrates on responses to large-scale wrongdoing in the context of an attempted shift from conflict and/or repression. In my book, The Conceptual Foundations of Transitional Justice I argue that transitional justice is a distinctive type of justice. Transitional justice requires the just pursuit of societal transformation. I define transformation relationally, as the terms defining interaction among citizens and between citizens and officials. Transformation is necessary because of the presence of (...) pervasive structural inequality and wrongdoing. Transformation is a practical possibility because of the uncertainty characteristic of transitions. Processes of transitional justice pursue transformation by dealing with past wrongs. The just pursuit of societal transformation requires heeding the moral claims of victims and moral demands on perpetrators. In this paper, I address four issues raised by Sirkku Hellsten, George Hull, Thaddeus Metz, and Margaret Urban Walker. I first discuss the methodological questions pressed. I then consider challenges to the substantive view of transitional justice I propose. I next turn to queries about the distinctiveness of transitional justice. Finally, I respond to skepticism about the necessity and value of a substantive normative theory of transitional justice. (shrink)

Is there a limit to the legitimate demands of morality? In particular, is there a limit to people's responsibility to promote the well-being of others, either directly or via social institutions? Utilitarianism admits no such limit, and is for that reason often said to be an unacceptably demanding moral and political view. In this original new study, Murphy argues that the charge of excessive demands amounts to little more than an affirmation of the status quo. The real problem with (...) utilitarianism is that it makes unfair demands on people who comply with it in our world of nonideal compliance. Murphy shows that this unfairness does not arise on a collective understanding of our responsibility for others' well being. Thus, according to Murphy, while there is no general problem to be raised about the extent of moral demands, there is a pressing need to acknowledge the collective nature of the demands of beneficence. Spontaneous abortion is rarely addressed in moral evaluations of abortion. Indeed, 'abortion' is virtually always taken to mean only induced abortion. After a brief review of medical aspects of spontaneous abortion, I attempt to articulate the moral implications of spontaneous abortion for the two poles of the abortion debate, the strong pro-abortion and the strong anti-abortion positions. I claim that spontaneous abortion has no moral relevance for strict pro-abortion positions but that the high incidence of spontaneous abortion is not (as (...) some claim) eo ipso any sort of justification for voluntarily induced abortion. Secondly, I show that if the strict anti-abortionist position is to be taken seriously in its insistence that prenatal life has a right to be protected by virtue of its being conceived, then it seems necessary to take measures to prevent spontaneous abortion and its presumptive causes, and this as a matter of moral obligation. Despite their obvious importance to social and political life, custom and customary law have largely escaped philosophical scrutiny. There are important recent philosophical analyses of convention, but none of custom. And customary law has been recently neglected by the dominant legal positivism. One reason for the neglect of custom is the familiar dichotomy between nature and convention. Social practices are said to be either by nature, and therefore assumed to be unalterable, or they are said to be by convention, and (...) therefore assumed to be created at will. But customs arise neither simply from nature nor from deliberate stipulation, so they are excluded by the familiar opposition of nature and convention. Custom is a notoriously vague concept: custom seems both to be natural and conventional. I attempt to show how custom bridges human nature and social norms. I argue that custom must be analyzed into two more logically basic concepts: habit and convention. Custom is a habitual convention and a conventional habit. I discuss habit and convention in relation to contemporary psychology and analytic philosophy. Habit roots custom in the physiology of human nature while convention links custom to social norms. Aristotle pioneered this approach to custom by using two words to describe what we call custom: ethos and nomos. Ethos focuses our attention on the habitual dimension of custom while nomos focuses our attention on the conventional dimension of custom. I argue that the function of law is to remedy the deficiencies of custom: law is custom’s instrument for shaping its own evolution. (shrink)

Many of the arguments against reductionism and fundamental theory as a method for explaining physical phenomena focus on the role of models as the appropriate vehicle for this task. While models can certainly provide us with a good deal of explanatory detail, problems arise when attempting to derive exact results from approximations. In addition, models typically fail to explain much of the stability and universality associated with critical point phenomena and phase transitions, phenomena sometimes referred to as "emergent." The paper (...) examines the connection between theoretical principles like spontaneous symmetry breaking and emergent phenomena and argues that new ways of thinking about emergence and fundamentalism are required in order to account for the behavior of many phenomena in condensed matter and other areas of physics. This essay argues that the concept of ‘reasonableness’plays an important role in Scanlon's, Rawls's, and Barry's theories of justice (or morality). The relationship between moral motivation and reasonableness is critically analysed. Specifically, the paper questions whether it is plausible to impute to the agents of construction the desire ‘to justify our actions to others on impartial terms’. It also argues that most of the work is done by the assumption that people are reasonable rather than by the contractarian formulation. The rhetoric of moral, spiritual and political decline represents a recurrent rhetorical form, one that has appeared throughout history in a variety of contexts. This article takes a closer look at one episode in the history of decline rhetoric -- the fourth-century anti-Christian critiques regarding Roman imperial decline, and Augustine's responses to them in his City of God -- in order to explore the phenomenon of decline rhetoric more deeply. Augustine's response to those who blamed Christianity for the empire's decline (...) took place on both the empirical and the interpretive levels. First, he drew on the Roman historians Sallust and Livy to argue that moral decline, if it took place at all, predated Christianity. Second, his theory of the two cities took issue with the notion of decline as a fundamental misunderstanding of historical change. The article closes by drawing out some implications of this particular study for approaching decline rhetoric in political life more generally, concluding with a consideration of the controversial remarks of Pat Robertson and Jerry Falwell, who viewed the 11 September attacks as divine punishment for American moral decline. This book argues that R.G. Collingwood’s philosophy is best understood as a diagnosis of and response to a crisis of Western civilisation. The various and complementary aspects of the crisis of civilisation are explored and Collingwood is demonstrated to be working in the traditions of Romanticism and ‘historicism’. On these subjects, the theories of Collingwood and Ortega y Gasset are contrasted with those of Nietzsche and Weber.

The conventional approach to interpreting biological vision systems and experimenting with computer vision systems has been overwhelmingly dominated by a representational view of information. Even more recent connectionist approaches, though embodying a substantial change in viewpoint, have only involved a change of the type of representation, to one of a distributed nature. An alternative view is the notion of information as being constructed and codependent rather than instructional and referential. This is an interpretation based on the more embracing viewpoint of (...) the complementary causal descriptions and symbolic descriptions playing clearly defined interrelated and dual roles, rather than mutually exclusive, or even muddled roles. This paper examines this radical change in perspective and compares it with a causality framework and with a position on the nature of perception which is based on the idea of universals. (shrink)
